AYD TO HIS MAJESTY KING CHARLES I, 1627 : WAPENTAKE OF WIRKSWORTH
Plus Alderwasley and Ashleyhay from the Hundred of Appletree.Back to MENU
From an article by The Rev R. Jowett Burton, in the Derbyshire Archaeological
Journal, Vol 21, 1899, p.69ff
Many in Derbyshire, like other counties at the time, considered it illegal for
Charles I to raise a levy (or "loan") in 1627, without the consent of Parliament.
"Persuasions, threats and force were used throughout the country to extort the
loan". This roll covered the hundred of Appletree and wapentake of Wirksworth,
listing the names of all people who "agreed" to lend money to His Majesty,
collected by Robert WILLYMOTT of Chaddesden, appointed Collector for these two
hundreds. This roll was signed by:Back to MENU

"COPYHOLD"
This explanation of 'copyhold' is from Liz Agar of the YORKSGEN list and
appears with her permission.
Copyhold is tenure of lands being parcel of a manor, 'at the will of
the lord according to the custom of the manor', by copy of the manorial
court roll.
Unlike freeholders, a copyholder could not just transfer his land to
his heirs or a third party. If e.g. he died, his death would be entered
in the manor court rolls. His heir(s) had to present to the manor
court to seek admission as the new tenant and pay a sum of money known
as a fine or relief. The admission was also noted in the court rolls.
Similarly if a copyhold tenant wished to transfer his land to a third
party, the surrender took place in court and was recorded with the
admission of the new tenant. The new tenant was given a copy of the
court roll entry to prove his title to the land. Hence 'copyhold'.
There were actually two types of copyhold - heritable copyhold and
copyhold for lives.
With 'heritable copyhold' the land passed on the death of the
copyholder to his heir, whose identity was determined by manor custom
usually primogeniture (eldest son) but could be gavelkind (all sons as
joint heirs). If the copyholder wanted to pass on his property
according to his will, he could do this by 'surrender to the use of his
will', this being recorded in the court rolls. When he died his will
was presented at the court and his heir admitted.
With 'copyhold for lives', the land remained with one or more people
for life, usually three lives - the tenant, his wife and his heir. On
the death of the last of the three the land reverted to the lord who
could then grant it to a new tenant. With this system the death of a
man (if the third life) could result in his children losing the land
when it reverted to the lord. Another custom of free bench existed
whereby a widow could retain tenure of the land until she remarried.
An aging tenant (if a widower and the third life) could take a new
young wife and enter into an agreement with her such that upon his
death she exercised her right to free bench, retaining the property
while allowing her step sons to farm the land.
There's lots more on the above in a wonderful book, Ancestral Trails,
by Mark D. Herber.
